Garden Clearance for Landlords and Rental Properties

Clear it to a state a tenant can realistically maintain, photograph it, and write down who does what. Most garden disputes are really disputes about what was agreed.

Rental gardens go wrong in a predictable way: handed over already beyond what a tenant can manage, with a clause saying the tenant will maintain it, and a dispute at the end about a state neither party can now prove.

The Void Period Is the Moment

It is the only time the garden is empty, access is unrestricted and nobody's possessions are in the way. Work that takes a day between tenancies takes considerably longer, and needs appointments, once somebody has moved in.

Clear to a Maintainable State, Not Just a Tidy One

The test is not whether it looks good on handover day. It is whether an ordinary tenant with an ordinary mower can keep it that way. A garden handed over immaculate but needing a long-reach trimmer and a green waste subscription will be overgrown within two years, and that is predictable rather than the tenant's failing.

In practice that means:

  • Hedges cut down to a height reachable from the ground
  • Borders reduced to something that does not need horticultural knowledge to manage
  • Anything that needs annual specialist attention dealt with, or removed
  • Grass areas that can be mown — level, accessible, no hidden obstacles
  • Bamboo and heavy ivy removed rather than cut back, because a tenant will not keep on top of either

The Paperwork That Prevents Arguments

  1. Photograph it thoroughly on handover, dated, from several positions. This is what any later disagreement is measured against
  2. Put the garden in the inventory properly, not as one line
  3. Say specifically what the tenant is responsible for. Mowing and general tidiness is reasonable and enforceable. A clause requiring a tenant to maintain a large hedge or mature trees is unlikely to be either
  4. Say what you are responsible for, and how often it will happen, so the tenant is not chasing
  5. Note who arranges access for any work you are arranging

The Part That Does Not Transfer

Safety remains the landlord's responsibility whatever the tenancy agreement says. Trees with defects, dead or unstable limbs, anything overhanging a neighbour or a footway, a collapsing structure — none of that moves onto the tenant. A void period is the right moment to have the trees looked at, because it is the one time access is straightforward.

Where Gardens Quietly Get Expensive

  • Trees grown up inside hedge lines — ash, sycamore and elder self-seed constantly and are invisible until they are the size of the house
  • Bamboo, which will be into the neighbouring garden and a neighbour dispute before anyone at the property mentions it
  • Ivy on the building, which gets into the roof edge while nobody is looking at the outside of a let property
  • Boundary hedges cut on one side only for several years, which is a dispute waiting to be had

Portfolios

Where several properties are involved, doing them in one visit is materially cheaper than one at a time, and it makes the cycle easier to keep. Late summer is the usual slot — after nesting, and the work holds its appearance through the winter.
